About Us

Department of Food and Drug Administration was carved out as an Independent department from the Health Department in the State of Haryana on January 4,2011 vide notification No. 4/3/2008-1HB-II dated 04.01.2011 for regulations of the Food Standard & Safety Act 2006 & Drugs and Cosmetics Act 1940 & Rules 1945 more effectively. These statutes are aimed at ensuring supply of quality medicines, cosmetics & food staffs to the public at large at affordable prices and also safeguarding the unwary public from misleading advertisement of drug/food articles & drugs abuse. Prior to this, food and drugs control programme in the state was functioning under Director General Health Services.

The Department of Food & Drug Administration is having responsibility of implementing various provisions of following major central legislations:

  1. Drugs and Cosmetics Act 1940 and Rules 1945.
  2. Drugs (Price Control) Order 1995.
  3. Drugs Magic Remedies (Objectionable Advertisement) Act 1954.
  4. Food Safety and Standard Act 2006.
  5. COTPA(Packging and Labelling) rule 2008.
  6. POISONS Act 1919.

The drug control set up regulates a variety of functions including licensing, inspection of drugs mfg. and sales/distribution channels, quality control of drugs and cosmetics, drug pricing, availability and affordability of drugs in the State. The Food Standard and Safety Act regulates the quality of food staffs, their purity, licensing/ registration of food business operators, inspections and sampling of food articles in the State. FDA is having to Head Quarter at Panchkula and offices at zonal and district places. The zonal offices are headed by the SDCO’s and district offices by DCO’s who have also been notified as DDO by the State.

There are 46 sanctioned posts of DCO’s, 10 posts of SDCO’s at zonal level, 3 posts of ASDC’s, one post of DSDC and one post of SDC at HQ. Out of these 96 posts of DCO’s, one post of DCO is at HQ. SDCO’s are responsible for inspection of mfg. units, blood banks and also perform functions as Licensing Authority for grant of retail and whole sale drugs license under the Drug Act. All the DCO’s are responsible for inspections of sale units and sampling of drugs and cosmetics in their respective area. They are also required to investigate complaints and inspect medical practitioner in their areas and perform functions under the DPCO and DMR Act 1954 and COTPA 2008.

The State Govt. has notified Licensing Authority under the Drug and Cosmetics Act 1940 and Rules 1945 to perform the statutory functions under the Act to grant license for sale as well as drug mfg. establishments in the State. The State Govt. has notified Senior Control Officers as the Licensing Authorities for the retail sale establishments for their respective zones namely Ambala, Hisar, Gurgaon, Faridabad, Rohtak, Karnal, Rewari, Sirsa, Sonepat and Kurukshetra. State Drug Controller has been notified as Licensing Authority for grant/renew license of DML including Homeopathic medicines as well as cosmetics. SDC has also been notified as Licensing Authority for grant of wholesale drugs license for the State which has been delegated to the SDCO’s for their respective jurisdictions. Similarly it has been also notified all DSDC, ASDC's, SDCO’s and DCO’s as “INSPECTOR“ under the Act to perform statutory functions of sampling of drug and cosmetics and inspections of mfg./sale units in the State. They are also vested with powers of filing criminal prosecutions against the offenders under the Act.

The State Govt. has notified all Food Safety Officers in the State under FSSA 2006 to perform statutory function of food sampling & inspection of food establishments under the Act. All FSO’s have also been notified as Registering Authorities for registration of food business operators in the State for their respective jurisdiction. Civil Surgeon of each district has been notified as Designated Officer to perform the functions of “Licensing Authority” under the FSSA2006.

The State has an independent drug testing laboratory under the statutory control of Government Analyst at Chandigarh to perform test/analysis of drugs/cosmetics samples under the Drugs & Cosmetics Act 1940. All kinds of drugs samples except those of vaccines/seras and medical devices are analysed at this statutory drug testing laboratory. The sample of vaccines/seras are tested at Central Research Institute Kasauli, Himachal Pardesh. Similarly State has two food testing laboratories, another at Karnal & one at Chandigarh to perform the statutory functions of testing of food samples under FSSA 2006. Now state has one EMAT machine for on spot testing of milk and one mobile food testing lab.

The Government has notified Government Analyst & Public Analyst to perform the statutory functions under the Drugs & Cosmetic Act 1940 and FSSA 2006 respectively. These test laboratories are well equipped to perform test/analysis on drugs and food samples seized by the field officers from time to time.
